CSW conformity: conformance enumeration

Dear helpdesk,

I'm trying to validate our CSW service capabilities by running test on Discovery Service CSW conformance class.
Our metadata passes the validator but not the Capabilities because of the following error:

Apparently, validator expects conformance class for regulation 1089/2010 rather than 976/2009. However 1089/2010 regulation is already existing in metadata and we need 976/2009 in order to pass M&R check for indicator NSi4.1.
We did some work on our CSW 6 months ago and it satisfied every validator test back then.

How can we solve this issue? Should the 976/2009 regulation exist in this XSD?
