1.4. “You” means an individual or entity exercising permissions granted by this License.
- Grant of Rights. Subject to the terms and conditions of this License, the UW grants You a worldwide, royalty-free, noncommercial, non-exclusive license to exercise the rights in the Software and/or Hardware as stated below:
2.1. The right to reproduce the Software and/or Hardware, to incorporate the Software and/or Hardware into another work, and to reproduce the Software and/or Hardware as incorporated in another work.
2.2. The right to create and reproduce Derivative Works provided that any such Derivative Works, including but not limited to any translation in any medium, takes reasonable steps to clearly label, demarcate or otherwise identify that changes were made to the original Software and/or Hardware.
2.3. The right to distribute and make available to the public the original and copies of the Software and/or Hardware or Derivative Works provided that the following conditions are met:

Representations, Warranties and Disclaimer. THE SOFTWARE AND/OR HARDWARE IS PROVIDED BY THE UW AND ANY CONTRIBUTORS “AS IS” AND UNLESS OTHERWISE MUTUALLY AGREED BY THE PARTIES IN WRITING, ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. THIS AGREEMENT SUPERSEDES ANY VERBAL UNDERSTANDINGS AND MAY ONLY BE MODIFIED OR AMENDED BY A WRITTEN AMENDMENT EXECUTED BY BOTH PARTY'S AUTHORIZED OFFICERS.

Limitation on Liability. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT SHALL THE UW AND ANY CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE AND/OR HARDWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Choice of Law. This Agreement is made in and shall be governed by the laws of the State of Washington excluding choice of law principles. Any suit, action, or proceeding arising out of or relating to this Agreement shall be decided in King County, Washington, United States of America. You accept the venue and jurisdiction of the Federal District Court of Western Washington, Seattle, or the King County Superior Courts.

Termination. This License and the rights granted herein will terminate automatically upon any breach by You of the terms of this License. Individuals or entities who have received the Software and/or Hardware and/or Derivative Works from You under this License will not have their licenses terminated provided such individuals or entities remain in full compliance with those licenses. Sections 4, 5, 6 and 7 will survive any termination of this License.
