gro is protected by the UW OPEN SOURCE LICENSE, which is described below.

THE SOFTWARE (AS DEFINED BELOW) AND HARDWARE DESIGNS (AS DEFINED BELOW) IS PROVIDED UNDER THE TERMS OF THIS OPEN SOURCE LICENSE (“LICENSE”). THE SOFTWARE IS PROTECTED BY COPYRIGHT AND/OR OTHER APPLICABLE LAW. ANY USE OF THIS SOFTWARE OTHER THAN AS AUTHORIZED UNDER THIS LICENSE OR COPYRIGHT LAW IS PROHIBITED.

BY EXERCISING ANY RIGHTS TO THE SOFTWARE AND/OR HARDWARE PROVIDED HERE, YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE. TO THE EXTENT THIS LICENSE MAY BE CONSIDERED A CONTRACT, THE UNIVERSITY OF WASHINGTON (“UW”) GRANTS YOU THE RIGHTS CONTAINED HERE IN CONSIDERATION OF YOUR ACCEPTANCE OF SUCH TERMS AND CONDITIONS.

TERMS AND CONDITIONS FOR USE, REPRODUCTION, AND DISTRIBUTION

  1. Definitions

1.1. “Derivative Works” means any work, whether in source or object form, that is based on the Software and/or Hardware and for which the editorial revisions, annotations, elaborations, or other modifications represent, as a whole, an original work of authorship. Derivative Works shall not include works that remain separable from, or merely link to the interfaces of the Software and Derivative Works thereof.

1.2. “Hardware” means any and all internal and external components of the bioreactor.

1.3. “Software” means the work of authorship, whether in source or object form, made available under this License, as indicated by a copyright notice that is included in or attached to the work.

1.4. “You” means an individual or entity exercising permissions granted by this License.

  1. Grant of Rights. Subject to the terms and conditions of this License, the UW grants You a worldwide, royalty-free, noncommercial, non-exclusive license to exercise the rights in the Software and/or Hardware as stated below:

2.1. The right to reproduce the Software and/or Hardware, to incorporate the Software and/or Hardware into another work, and to reproduce the Software and/or Hardware as incorporated in another work.

2.2. The right to create and reproduce Derivative Works provided that any such Derivative Works, including but not limited to any translation in any medium, takes reasonable steps to clearly label, demarcate or otherwise identify that changes were made to the original Software and/or Hardware.

2.3. The right to distribute and make available to the public the original and copies of the Software and/or Hardware or Derivative Works provided that the following conditions are met:

  • It must be made available under a License that prohibits Commercial Use (as defined in Section 3.2) of the Derivative Works and/or the Software and/or Hardware;
  • You must provide notices that the Software and/or Hardware is provided under this License and that there is full disclaimer of any warranties and liabilities.
  • Attribution must be included in your source code and any documentation that you include with the release of your software; and
  • A copy of this License must be included with each copy of the Software and/or Hardware and it must retain the following copyright notice: Copyright © University of Washington 2012.
  1. Restrictions

3.1. Subject to Section 2 above, all rights not expressly granted by UW are hereby reserved.

3.2. The rights granted in Section 2 above shall not be exercised in any manner that is primarily intended for or directed toward commercial advantage or private monetary compensation (“Commercial Use”). Any distribution, use, or modification of the Software and/or Hardware and/or Derivative Works shall be done solely for noncommercial purposes.

3.3. The name, trademarks, and/or logos of the UW may not be used to endorse or promote products derived from the Software and/or Hardware without specific prior written permission.

  1. Representations, Warranties and Disclaimer. THE SOFTWARE AND/OR HARDWARE IS PROVIDED BY THE UW AND ANY CONTRIBUTORS “AS IS” AND UNLESS OTHERWISE MUTUALLY AGREED BY THE PARTIES IN WRITING, ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. THIS AGREEMENT SUPERSEDES ANY VERBAL UNDERSTANDINGS AND MAY ONLY BE MODIFIED OR AMENDED BY A WRITTEN AMENDMENT EXECUTED BY BOTH PARTY'S AUTHORIZED OFFICERS.

  2. Limitation on Liability. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT SHALL THE UW AND ANY CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE AND/OR HARDWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  3. Choice of Law. This Agreement is made in and shall be governed by the laws of the State of Washington excluding choice of law principles. Any suit, action, or proceeding arising out of or relating to this Agreement shall be decided in King County, Washington, United States of America. You accept the venue and jurisdiction of the Federal District Court of Western Washington, Seattle, or the King County Superior Courts.

  4. Termination. This License and the rights granted herein will terminate automatically upon any breach by You of the terms of this License. Individuals or entities who have received the Software and/or Hardware and/or Derivative Works from You under this License will not have their licenses terminated provided such individuals or entities remain in full compliance with those licenses. Sections 4, 5, 6 and 7 will survive any termination of this License.
