Is this permitted (part of the spec suggests it is), and if so what's the expected behaviour? Do we create an empty object?

Clarify the Protocol Operations requirements to ensure that In-Progress can also be passed to Empty Body Create requests against the Service-URL
Add a new section to the SWORDv3 Behaviours document describing how to create an empty container with an empty request to the Service-URL
